Issue related to formation of Partnership
05-Nov-2024 (In Startup Law)
Greetings,
Are there any exceptions to the effects of Non-Registration of a Partnership? Please explain it in as much detail as possible as I am confused regarding the same.
Under the Indian Partnership Act, 1932, the non-registration of a partnership firm restricts the firm and its partners from enforcing their rights in a court of law, which could be a significant limitation. However, there are certain exceptions to these effects where non-registration does not prevent the partnership from exercising specific rights or pursuing specific actions. third parties can still take legal action to enforce their claims or rights against the partnership firm, even if it is not registered.
if partners wish to dissolve the partnership, they may proceed to do so legally, without being registered
