19-May-2023 (In Startup Law)
Hi, I am Sneha Saraf, Product Manager with Jubnation.com. Jubination is a health and wellness services company where we do blood tests, dr. and diet consultation etc.( Consultations are always online). Till now, our doctor consultations used be basic depending upon patients blood test reports and it used to via mail with no medicine prescriptions. But now since we are expanding our business, having packages fr people living with chronic disease like diabetes, also have senior doctors on on- board, so i would like to ask how legal it is in India to prescribe medicines online?

This is a two part question-

Buying medicines online may be legal, provided a valid doctor's prescription is uploaded and is assessed by an authorized merchant, prior to despatch/sale of medicines in question.

Prescribing medication online becomes complex because the medical laws only allow a licensed practitioner to prescribe medication here also there are different classes of medication some which are allowed to be sold over the counter, and others which are 'controlled.'

we would need some more details of the business model to understand what the company actually intends on doing.
