I want to live stream the ambience of my restaurant on my portal. Is it permissible or not?

The answer to this question will be affirmative.

As per the Indian law broadcasting rights rest with those who own the copyright of it or with the one who holds the permission for it.

Now see the checklist and analyze your case –

Since it is you who own the restaurant and the website so naturally the rights vested in them whether physical or intellectual (Copyright) vest with you. Further, you intend to broadcast your restaurant’s ambience on your restaurant's website portal. So technically you are permitted to do so.

However, there are some glitches which you may like to look upon before going ahead with your planning.

1. Right to Privacy

The people who are visiting your restaurants do not intend to get themselves broadcasted without their knowledge. People who buy tickets to see sports matches in a stadium know that the game is being captured by the camera and in the process they might get captured. Similarly people who check into airport know that they are under camera surveillance and these camera footages can be used to ascertain their identity etc.

But this might not be the case with a simple restaurant where someone has come just to dine out. May be he/she do not want to get noticed that he/she checked into your restaurant or may be he/she do not want the world to know at what time where he/she was or with whom. So in case you wish to go ahead with your planning of live streaming then you have to have a billboard which specifically says that, “this place is under camera surveillance and the audience dining out here are being live stream over the restaurant’s website portal.”

Mind you, Right to Privacy is guaranteed by the Constitution of India and that too under fundamental rights! Taking it lightly may cause you some serious trouble.

2. Those footage are raw footage

This you may count as a sub-set of right to privacy. People who participate into some sort of broadcasting shows know that they are getting broadcasted. So to assist them, either they have a script based on which they act, or they have some job to do (sportsman) or they are participating in some reality shows and knows that they have to live a normal life under the camera and have to perform some task. So in all the above cases, the content which you get at last is as per the viewer’s choice.

However, broadcasting your restaurant ambience will showcase the raw footage to those who will access your restaurant’s website. There may be some cases where people may be found indulging in actions like PDA (Public Display of Affection), or some verbal abuses. This again will lead to violation of Right to Privacy or in worst cases may also bring Criminal laws into action which you obviously don’t want to.

Conclusion

Although you can live stream the ambience of your restaurant on your restaurant’s portal but you should insure that you are able to come over the glitches mentioned above.
