Seller didn't pay the transfer charges and buyer paid by misled

Hi , I am vinit . I purchased a flat in resale in signature global Gurugram haryana. while transferring process Amit told I have paid around 42 lakh to builder and took the same amount from me and I also saw the ledger that what amount got paid and how much pending for future. But the catch is around 42 lakh has the TRANSFER CHARGES included which was around 417127.seller is liable to pay as per rule,as per my ATS. But he misled me and I paid that amount through UPI. Now seller not returning
