You may file a civil suit for declaration and injunction to restrain your partner from illegally taking away business assets. Since you both were partners, the transaction will fall under the Indian Partnership act and contract act, not the Money Lending (Sahukari) Act, unless your partner is habitually engaged in lending money at interest. Charging 15% interest as mutually agreed upon does not automatically amount to a money-lending activity; it will be treated as a contractual term between partners under Section 10 of the Indian Contract Act, 1872. You can therefore contest any false police complaint by producing proof of payments, terms of partnership, and correspondence showing it was a business arrangement and not a loan transaction. If he continues to threaten or misuse police machinery, you may also file a complaint under Section 182 IPC (false information to the public servant) Your case can be properly evaluated only after reviewing the relevant documents and communication between you.

Check Your Partnership Deed First This is the main legal document that controls how decisions are made. Check if it mentions: How dissolution should happen Notice period for exiting partners Rights of each partner Profit/loss sharing and settlement process 2. Forced Dissolution Is Not Valid Unless: A partnership cannot be dissolved forcefully unless: All partners ally agree Partnership deed allows it
