Money given to a friend without written agreement, can case be filed
17-Sep-2023 (In Recovery Law)
I have given money to my friend without any agreement.Rs 2lacs in cash and RS 5 lacs in his account via rtgs.in Nov 2014 &2015 respectively. He was giving me interest on that money.now he is not giving back the money.can I file case against him or now if I make an agreement with him ,will it work.
Firstly, send him a legal notice through an advocate requiring him to repay the amount within stipulated time period in the said notice which is generally 30 days. In case he doesn’t return the amount then you can file a civil case in appropriate Civil Court for recovery of debt.
The amount of Rs 5 Lakh which was transferred by you through RTGS can be proved by showing the proof of transfer through RTGS. If you were receiving the interest through bank transaction then that would be in your favour and you can produce the statement of your bank account and prove the existence of debt.
There is no point in entering into agreement with your friend at this stage. Moreover, he won’t agree to sign any agreement if he doesn’t have the intention to repay the amount.
