Investment recovery amount from tenant

17-Aug-2025 (In Recovery Law)
I have rented my flat and my tenant works as a stock broker. One of my close relative have invested 2 lac with him, now my tenant has done fraud and is absconding leaving his wife in my flat. I have asked his wife to vacate my flat, which she is ready to do.He has paid rent till last month and there are no outstanding dues as such between me and my tenant. I need to know if I can help recover my relatives invested amount through the wife or any assests available in my house.

You cannot recover your relative’s investment by keeping her or her belongings, because she is not a party to the transaction of investment and you will be creating an unnecessary legal problem for yourself. Regarding recovery of the invested money, your relative has to proceed directly against the tenant who took the money and absconded. The proper legal step is for your relative to file a police complaint for cheating and fraud, along with all proof of investment such as receipts, transfers, or any written communication. The police can investigate, trace him, and also freeze his bank accounts or assets if required. At the same time, a civil recovery suit can also be filed against the tenant to claim back the invested amount. But you as a landlord cannot legally attach his wife’s property or any items lying in your flat to recover that money, since there is no debt between you and the tenant.
