Whether daughters of my grandfather entitled for share in property

26-Jan-2023 (In Property Law)

My Grand Father acquired a property in the year 1935. He had two sons and six daughters of whom only two daughters and a son are alive. My grand Father died in the year 1944 and left behind the property without a will. According to the women's rights to property act of 1937 only my Grand Mother(not alive as on date) and two sons of my grand father will succeed to the said property. Further Section 8 of the Hindu Succession Act of 1956 applies in the case where Hindu male dies after the commencement of the act. My question is whether the daughters of m y grand father are entitled to it

Since your grandfather died before the amendment to the Hindu Succession Act in 2005 which gave an equal share to the daughters in the property, the daughters will not have a share if the property is partitioned. However, they may have a right to be maintainance from the property. If this response does not answer your query sufficiently, do post your query again with more details.
