31-Mar-2025 (In Property Law)
Ia partion suit was decree pass, in the suit deree daughter got very less share as the property was ancestral. Decree holder did not filled execution petition. Now he has filled execution pitition. Now as law changed and daughter can get equal share,. So can this suit be appose to execution petition please advice me
Even if the law changes, the effect of the old law remains in force. So you can always opt for execution of a decree even if the order was passed under the old law. Also, make sure that the execution is filed within limitation. Feel free to contact me for seeking any legal advice as regards the same.
