What will the course of action for usurped of land
20-Jun-2023 (In Property Law)
I had purchased a plot of 200 sq yds, and properly registered in my name. After that when I was making a house in my plot, my adjacent neighbour claimed that I have usurped some 40 sq feet of his land, and he filed a suit in court and also applied for stay order. But his stay order has been denied for the time being, and I am continuing construction. Now both parties are going on dates. If suppose it is found that his land has actually been usurped by the person from whom I have purchased the land, what will happen and what course of action do I need to take?
In this scenario you should first check the sale deed and see what is the area that has been allotted to you along with the map. After that you can also match about the same from the original registry. You can also file a suit for permanent injunction to ensure that no one interferes in the enjoyment of your area of property.
