This is my response to you:
1. Yes if you are the owner of the flat then you can claim what is yours;
2. Although the period of limitation would run against you but you can still contest the matter;
3. You will need to file notice for eviction;
4. If he does not respond then you have to approach the court for suit for eviction;
5. Since it is family, I normally wouldn't suggest this, but you can take assistance of police as well.

Incase all property documents, Property tax, Electricity bill are on your name in such circumstances you can file Eviction suit and get your flat vacated. Important criteria is documents and utility bills if it is in your name you can prove you are the owner of the flat.

Yes definitely you can ask him to vacate, you just need to show the property stands in your name and not in any one else name of he does not vacate the premises you can take him to court of law where you can get him out of the property.
