Trespass of property of a person without his consent, by another person without authority, has been defined as criminal trespass under Section 441 of the Indian Penal Code, 1860. The remedies which are available to you if anyone trespasses or encroaches upon your property are to get an injunction order for stopping that person from making any encroachment or trespassing upon your property, and you can also claim for the damages which you have suffered due to that encroachment or trespass.

If you are the owner of the property and someone else has illegally entered your premises, then you can file police complaint against him. For more assistance I also require to understand exactly about the matter in detail.
