What to do if arrest warrant is given due to non presence in court

09-Aug-2023 (In Property Law)
Hi, My father was the witness in a property will. Currently the will is under probate. The high court send a bailiff, but my father ignored him. Now we are told that the lawyer (probate) has issued an arrest warrant against my dad with a bail able deposit of 25000. What will happen now? Will police arrest him n take him to their custody? Do we have to pay 25000? He didn't go to the court or accepted the bailiff as he was busy with his work. I am worried what can i do ?

It is a bailable warrant. Hence the police will show arrest and then release your father after paying the bail amount and due formalities. However they will not put your father in jail if you pay the amount. Also make sure your father remains present in the Court next time.

Take help of a lawyer. Go to the court and make plea for why you couldn't remain present before the court. You don't need to deposit that much sum in the court. Ask your lawyer to cancel warrant issued against your father. Please respect court's procedure.
