What options available after Rera judgement except going to appellate

27-Apr-2023 (In Property Law)
I had filed a case against the builder in Haryana RERA but judges were not ready to hear our arguments. They had given decision based on the other complaints against the same builder. Judge did not listen to us at all. Now he has given judgement of 10.7% per annum interest rate without getting delivery date committed from builder. We know builder is not going to complete the project and he proudly says I can fight till supreme court and they will also not be able to do us anything as in case of Amrapali (no projects got auctioned). he is ready to go jail but we want our money back. I am not satisified with RERA judgement. I am looking for other options like NCLT, NCDRC, state consumer forum, economic offences wings, etc whichever is fastest. 1. Where can I approach after RERA judgement? My judgement has come but I have not yet got it applied. 2. If builder does not start paying me interest from 90 days of order, then can I approach NCLT?

the best bet for you is NCDRC because consumer protection act is a beneficial legislation and the proceedings thereunder are in addition and not in derogation to any other proceedings. the fallout of that is that you can of course pursue proceedings before NCLT, rera at, etc. without worrying about the NCDRC proceedings. and it's time saving as well.

As a matter of a statutory right, any person aggrieved by an order passed by state RERA can prefer a first appeal before RERA itself, then HC and then yeh Supreme Court. However, you also have an option of approaching the NCLT for speedy Redressal as a home buyer.
For further discussion, it would be beneficial to know the details of the matter.
