What is the legal share of sister in mother's property?

After my mother death we 2 brothers and 1 sister are owners of the property as per nomination form filled up by my mother. But 1 brother and sister want to sell the property and distribute the money equally among three of us. while 1 brother who is staying with my mother is not agreeing to sell the property nor he is giving any money to his 1 brother and sister as there share.Please advice as I am in favour of selling the property.
File a civil suit in the Court for declaration of title, partition and separate possession of the property. Court will appoint a commissioner who will effect the partition of the said property. Later you can sell your part of the said property.
