What is the Duration to file a suit after sending a legal notice ?

I had sent legal notice for partition during 2008 but filed partition suit during 2013 since there was no reply for my legal notice. Will the suit get dismissed on the grounds that I had filed late after sending the legal notice?

There is no limitation on this type of suit. If the Respondents bring this issue during trial, you can mention that negotiations & mediation efforts were being taken by u. Family partition suits

There is no time limit for filing a partition suit. Also the partition suit or partition itself will not be affected by law of adverse possession too. Hence need not worry about the long gap of time between notice and the filing of the suit. Infact a notice for partition is not a mandatory element for filing a partition suit. Don't be worried about it.
