18-Mar-2023 (In Property Law)
Sec 64 and 65 of the limitation act provide for period of limitation I.e 12 years. I have read somewhere through this the law differentiated between proprietary and possessory title. nnPlease explain.
Hello Sir. This is Adv. Shrikant Samantara.
True Section 64 and 65 provide for a period of limitation of 12 years( One Exception: Section 6 of the Specific Relief Act 1963, which provide limitation period of 6 months, in a case when a person is dispossessed unlawfully)
Further it true that, law differentiates between Possessory Title and Proprietary Title.
Possession is prima facie proof of ownership of property, it is a good title against all, who cannot show better title.
For further clarity you may contact me, feel free to contact.
Regards.
