Seller had committed in the ATS to sell flat along with 2 parking spaces. However, in the conveyence deed prepared later, it is observed that he has rights on only one parking space. Can I cancel the ATS and demand compensation from the seller?
Yes you can cancel the ATS and you can demand compensation in form of interest over the earnest money that has been paid by you. But you cannot demand more than that as the purchaser of any property shall remain aware while purchasing any property and he shall check out each and every documents related to the property under sale, before entering into ATS.
