What happens to Ownership of apartment after owner's death?

What happens to an apartment if the owner dies and there are no heirs? Can the developer/builder claim back the apartment if they pay the maintenance of the apartment regularly? can it be sold? can it be rented?
The apartment has been registered in the owner's name.
1. The developer / builder can not register the property on their own, if the owner dies and no heirs.
2. The intestacy law says, the apartment can only be rented with the permission of local sub-registered office.
