What action against fraudulent sale of land

I have purchased a agriculture land in Gauribidnur Taluk and I have paid 2 Lacs as advance amount in 2016. No time limit is mentioned in agreement. The land owners have hide the fact that the property is already mortgaged to some other party. Till date the same is not being released. The owners are not returning my advance amount. what action shall be taken, pl let me know.

1. Even though it is criminal offence hiding the details about mortgage and got into sale agreement, I suggest you to issue legal notice to the land owner for the settlement.

2. In case, if owner not responding then approach civil court to file recovery suit against him.
