We belong to SC category can we sell land to general category person

Hi, I belong to SC category belonging to Uttarakhand. My father brought a piece of land arnd 15 yrs ago but the farad of the land does not say that it belong to an SC person. That time my father bought it as a general category person. Now he want to sell it to a person belonging to general category. Can he do that? Will it come under U.P.Z.A.L.R Act. ? Will permission of DC will be required for allowing purchase? Please reply as soon as possible. Thanks

From what you have narrated, it appears you won't need permission. However, these things are subject to other documents such as ration card etc where you have claimed the benefit of being SC. Someone can challenge the sale based on these other documents. Therefore, it is best if you show the documents and SC certificates to a lawyer once before selling.

Yes with special permission from DM you can sell it. Its depends on your term with Dm then only you can get permission. So if its in nanital i will make available permission for that u will have to pay fee . And please tell me how much land do u have.

Law is simple in this. In case of agriculture land, person of SC category cannot sell land to general category In your case whether you misrepresented your identity or not, it is written down in sale deed that seller belongs to general category and not SC. If the same comes out to be false lately then land automatically vests in government. In case of commercial there is no such boundation of SC or general as no UPZALR is applied.
