We are doing farming since last 45 yrs on land
02-Apr-2025 (In Property Law)
7/12 is on our name since 1981. Before this it was on actual owner name. He has given this land to us for cultivation without any documentation in 1981. since then he has not tried to recover his farm. Now he has taken objection. Can we get this land in case of court case.
Adverse Possession (Article 65 of the Limitation Act, 1963)
If a person openly, continuously, and peacefully possesses land for more than 12 years, the original owner loses the right to reclaim it.
You have possessed the land since 1981 (more than 40 years), which is well beyond the required 12 years Possible Legal Actions You Can Take:
File a Declaratory Suit in Civil Court
Seek a declaration of ownership based on adverse possession.
Request the court to bar the original owner from reclaiming the land.
Defend in Case of Litigation
If the original owner files a case to recover the land, argue adverse possession as your defense.
Submit land records, tax receipts, and witness statements proving your long-term possession.
