Water Seepage from above flat bathroom

Hi Sir/madam,
In my flat in Bangalore , there is a water seepage in the bathroom from the above flat bathroom. The above flat owner is not agreeing to repair the water leak.
Please let me know the next set of steps I can take legally.
1. As it is structural issue, you are not liable to get it repaired at your own cost.
2. I suggest you to issue legal notice to owner to repair the same. Even after owner receive notice, if he/she still refuse to repair then you can get it repaired at your own cost and later you may file recovery suit against owner to claim the expenditure.
