Water leakage in my shop due to fault of resident in society

12-Jul-2023 (In Property Law)
I am a Hindu by religion. I own a shop and their is a severe water leakage issue in my shop. The problem started from the garden which is on the first floor of the building. When I asked the society to fix the problem first they refused and when they agreed they took money from all the shop owners only. Even after the water proofing was done the problem still pertains . Due to rains now the water leakage is damaging my shop POP and lighting. I can't afford it any more now. Can I file any case against them. Can I seek any legal help

You can approach the consumer forum or civil court for the nuisance and for damages. You first you will have to give notice to the society for your complaint and send the copy to the Dy Registrar Coop societies.

Filing legal case is not solution to your problem. when the result of case obtained till your fifth generation will came to your shop.
In this case give legal notice to first floor flat owner to comply water proofing on his floor as it will damages you POP. I am quite sure that after getting notice he will ready to make his floor water proof.
