Want equal division of property between son and daughter

22-Feb-2023 (In Property Law)

Greetings, I would be grateful for competent and expert comments on the following: In the absence of a written and documented will, do sons and daughters without any scope for intrepretation or dispute get an exactly equal share of their parents' property? This refers to the personal property of the parents and not a HUF. 2. Also if the son disputes an equal division, would the daughter have to spend much money in claiming her equal share in front of the competent courts ? Thanks

In the event of intestate death of the owner of an immovable property, the said self acquired property shall devolve equally among all his/her legal heirs or successors in interest. There is no question of one of the legal heir getting more and another getting lesser share in that property. Law is equal and common to every one, it has no gender bias as far as Hindu Law is concerned.

2) There is no such thing called as spending much money for court cases if one decides to approach court seeking partition and separation of his/her legitimate share in the intestate property.
The lawyer fee and the court fee will depend on the lawyer and state in which the suit is being filed.
