Violation of Setback during the construction of house

I am constructing a house in BBMP jurisdiction with violation in set back. House is at foundation level.. My neighbor has already constructed house with similar violation and complained to BBMP and not coming for compromise. His argument is that his violation is old and now I should not violate. Can we file a case against him.
you have to take all your permissions from BBMP in order to construct your house. you can file an FIR with the police against your neighbors in order to stop him from interfering with your construction and peaceful enjoyment of your property.
