Hello Sir.

This is advocate Shrikant Samantara. More information would be needed at your end to answer your query appropriately, such as ?

Was your Grandfather the only son of your great grandfather?

Was there any will in existence by your great grandfather or grandfather?

Is there any Family settlement deed or Partition deed between your father and uncles ?

Jist for information: if a person dies intestate, without making a will, his self acquired property would devolve equally among his class 1 legal heirs.
In the above scenario, one or two of the legal heirs can file a partition suit before appropriate court of law for equal distribution.

Regards.

We need more facts on this :
1. Where is this property located ?
2. Did the three sons ever did any family settlement deed in writing ?
3. Where is this property located?
If they haven’t executed any document for there partition then yes you can file a suit for Partion in equal ratio in this regard along with possession etc
B in touch
Thanks
