What is the procedure to transfer flat from deceased father to son incase there is no will by father or no nomination given to society

This is my response to you:
1. You will need to obtain succession certificate;
2. Then the other legal heirs will have to submit their relinquishment deed and then transfer the same to you;
3. Once that is done then you can approach the sub-registrar and make your mutation entry in the property records;
4. Only after you complete this process you get a perfect title to the property.

Firstly you need to approach an advocate for proper advise with all the details. Also you can write a letter to the society requesting transfer of Flat and then you can approach Co-operative court before Registrar of your ward and make an application.

In India, as per the provisions of Indian Succession Act, 1925 if one dies without writing a valid will, he is said to be died intestate and his property will be distributed as per the provisions of the succession law applicable to him. So if you want that your hard earned wealth should be distributed as per your wish it is important to write proper will. In India, Hindus, Sikhs and Jains are covered under Hindu Succession Act 1956 and Indian Succession Act, 1925. Muslims are governed by their Muslim Law. Christians, Parsis and Jews are governed by Indian Succession Act, 1925
