Title suit exparte decree after argument stage
22-May-2025 (In Property Law)
Plot has no RS and LR ROR on behalf of any person and not in vested category also. But has registered sale deed, chain deed, electric connection ob the name of plantiff. Are this documents enough to establish title if the suit run exparte ?
While RS (Revisional Survey) and LR ROR (Land Records - Record of Rights) are important land ownership indicators, registered sale deed, chain of title documents, and utility connections like electricity in the plaintiff's name are significant documentary evidence to establish possession and claim over the property. In an ex parte proceeding, if these documents are genuine and uncontested, they may be sufficient for the court to presume ownership or possession. However, lack of ROR can raise issues in certain jurisdictions. You should consult with me to evaluate the documents in detail and ensure proper pleadings are made to establish title effectively before the court.
