03-Oct-2024 (In Property Law)
My grandfather displaced from Pakistan during partition. He received a property in Azadpur Delhi from govt of india in part cash payment and part as compensation for property left in Pakistan under The Displaced Persons (Compensation and Rehabilitation) Act, 1954. Later he transferred the property in name of my father through a GPA and Will. Can my father sell such property now?

Yes your father can transfer the rights with interest via GPA bundle ! This is the best option if u can’t get the proper sale deed of the said property! You need to hire expert advocate to draft all the documents to be on the safer side ! Pl b in touch

If your father is the sole owner of the property and the GPA is registered then he can sell the property. For selling of the property the registration of the GPA is an essential requirement after the supreme court 2011 judgment.
