Supreme Court decision about property share of daughter.

07-Nov-2023 (In Property Law)

Supreme Court gives the decision on 2 Nov 2015 that a daughter cannot claim the share of her father's property if her father died before 9 sep 2005 . My father died in 1987 and his property has divided in two part me and my sister on mar 2014 as per law . Now can I file a case in court against my sister to give the shared money back to me according the decision of SC on 2 Nov 2015.

The Supreme Court Judgement is pertaining to ancesteral property.

If your father had self acquired property and since ince your father died intestate and if it was his self acquired property then as per section 10 of Hindu Succession Act, the property will devolve to all his legal heir including daugthers.

The daugthers can file suit for partition thereby seeking their share in the property.
