Stamp duty of 30yr old property

Hello, My uncle is 64 yr old. He had purchased a flat in co-op hsg society in 1990. It was a second transaction. The man had an agreement deed with his signature on papers with my uncle. Later that man left India and not in touch anymore.. this property is in Nasik.. The property stamp duty was not paid, due to my uncle's unawareness. Then Thier children grew up and they inquired. Now they want to pay stamp duty and do the registration. Kindly advise on the procedure.. The seller in not traceable.. he no more stays at the address he had given us.

Hello, First thing you can do is file the same under the amnesty scheme where you will save the penalty on the pending stamp duty. The last date of the amnesty scheme is 31st Aug 2019. Apart from that if you want to get it register now both the parties have to be presented where in your case its not possible.

This is my response to you: 1. File an advetisement in newspaper about it; 2. Try to send a notice to his last known address; 3. If all fails then file a suit in the court for declaration of property; 4. Consult a local lawyer and take steps.
