Small Parking allocation issue
19-Sep-2024 (In Property Law)
Parking allocated to me is fairly small than others even after purchasing bigger unit and paying floor rise . However parking size might be in norm
If the parking space allocated to you is smaller than that of other residents, despite having purchased a larger unit and paying for a floor rise, you may have grounds to address this issue with the builder or the housing society.
First, review the sale agreement and any documentation related to your purchase to confirm the specifications regarding parking allocation. Look for any clauses that mention parking sizes or rights to a specific type of parking space.
Next, gather evidence of the differences in parking sizes among residents. This can include photographs, measurements, or comparisons with other units. If the parking space you received is indeed within the norms set by local regulations, it may be more challenging to contest, but you can still raise concerns about fairness and equity.
You should communicate your concerns to the builder or the housing society, highlighting the discrepancy and requesting a resolution. If the builder or society is unresponsive, consider escalating the matter by filing a complaint with the local real estate regulatory authority or seeking legal advice on how to proceed.
Ultimately, while parking sizes may adhere to certain norms, your case can focus on the fairness of the allocation relative to your investment in the property.
