share of daughter in self acquired and ancestral property
23-Apr-2023 (In Property Law)
i hv 3 brothers nd i am only daughter of my parents. My parents died in 2001 nd there is no will. My father has self acquired property nd ancestral property..we r hindu nd staying in Rajasthan. Can i get share
According to the recent Supreme Court Judgment a daughter will have equal share in the self acquired property of the father when the father died after September 2005. If the father died before that then daughter will have no share in the father’s property. In your case you will not get share in the self acquired property of your parents but you can claim for share in the ancestral property. The ancestral property will be distributed according to the Hindu Succession Act.
