Share Certificate Transfer after Father's death

14-Aug-2023 (In Property Law)
Hi, my father had one residential property on his name(single owner) and he has passed away. My mother already passed away few years ago. I have one brother and one sister(married- living with husband and one adult son-19 yrs) My brother and sister are ready to transfer the flat on my name. Society has also agreed to transfer the share certificate on my name after getting NOC from my bro/sister. Should I take signature of Sister's husband and her son also on NOC? Or only signature of my brother and sister is enough? thanks GMANGTANI

Respected sir/madam, For transferring flat in your name you have to get signature on noc of your brother and sister is enough. You have to submit other transfer forms to society and paper notice in two local news paper

This is my response to you: 1. An NOC will not suffice; 2. It is better if you enter into a relase deed; 3. Register this deed and you will have right, title and ownership on the property; 4. Consult a local lawyer and take steps.
