26-Jun-2025 (In Property Law)
Mai Shobha Devi 2nd wife of Late Arvind Kumar Singh. First wife already expired then I got married. From first wife my husband has three children one daughter and two son. daughter got married. From my wedlock I have one son and one daughter. My husband expired in 2021. My husband has purchased a plot in Muzaffarpur city for residential purpose. In 2021 my husband son from first wife sold the plot without consent of mine to his maternal uncle. I want get this sale deed cancelled. Plz help.
The plot purchased by your husband was under whose ownership and possession? Before dying has he transferred the ownership & possession of that land to anyone or not? If yes, then the property will belong to that person to whom it was transferred, if not, then it shall be divided equally between you and the rest of the other surviving legal heirs. Please clarify the situation first that whether your step son has sold the property for which he was also entitled or whether without any entitlement he has sold the property in question. If he was entitled then you will have no remedy, if he was not entitled then you can file cancellation of sale deed before the civil court.
