Both my in-laws expired leaving a house present value app 2 Crores without writing will. Heirs'__ two sons( one died) 5 daughters.
Can the house be sold without consent of any one of the heirs (first daughter)? What is the legal procedure to sell the house and to divide tha money among heirs as per their wish?
After the intestate death of your parents inlaw, their estate devolved equally upon all their surviving Class-I legal heirs, with each entitled to an undivided one-seventh share in it. No one can sell the property without the express consent of all the other legal heirs either by way of joint execution of the sale deed or by forgoing their share by a relinquishment deed. In case of any dispute, a title suit needs to be filed at the proper court in consultation with a competent advocate and order for the selling of the property and for sharing of the proceeds thereof obtained.
