Seepage Issue from the upper floor flat. Landlord living in Gurugram

I am living on 2nd floor, and flat owner on 3rd floor is not willing to repair the leakage from his toilet which is causing a serious damage to my bathroom/dining room ceiling. As it is increasing on a daily basis, I am not sure to file a civil suit since it could take a long time to acquire a resolution. These are the actions I have taken till now. 1) Send him multiple requests on WhatsApp with pictures of the damage. 2) Called to police and made the complaint, but no action taken by them.

First of all rather than going legally you should serve them a legal notice and in that notice you can write that either stop all these harassments or face legal action which will be at your own risk. After that if he fails to give you a satisfactory reply then you can anytime file a complaint in writing to the police station according to your jurisdiction.
