Sale of Property given on rent be made if it also has a Case on it.

Can I sale my property given on rent along with liability of the case running against the lessee to vacate the property and he also filed a case to charge money from us as shop is been closed since case as electricity got disconnected by Electricity People.

No, you cannot sell the property if the court has ordered that no third party interest can be made in the property. any ways if you sell the property you cannot transfer your liability or case to the new owners as the case is going against you and not the purchasers. please inform your purchasers that a case is going against the property else it can lead you to further litigation.

Yes you can sell the property if there is no injunction from any court, if any customer is available to purchase the property in existing conditions. You have to bear the existing liabilities before the sale is executed.
