Hi sirs, My brother died due to blood cancer without having will etc. He got his mother 68 years old alive. He was divorced wife in 2014. One son living with his mother. Now we have got legal heir certificate for my mother and her grand son(50:50). My mother want to sell the property and pay the half share in the bank account in minor's name. After getting court order, does my mother legally allowed to do so? Thanks

Your mother cannot sell the minor grandson's share in the property. To sell the minor's share she needs court's permission to do so. As the guardian and next friend the minor's mother will be a party in that case. If the court permits to sell the minor's share then the whole property can be sold by your mother along with the guardian and next friend of the minor.
