07-Nov-2023 (In Property Law)

my father had 3 sons and 3 daughters (i am one of the 3 daughters) but my father and mother died without making any will or dividing the property but after my fathers and mothers death the property was divided only among the brothers and registered in sub register office in 1999 without the consent of any of 3 daughters (including me) . sir do i and my sister have share in the property? can we question that registeration which took place without our consent in 1999 and take equal share in the property?

Since your father died intestate and if it was his self acquired property then as per section 10 of Hindu Succession Act, the property will devolve to all his legal heir including daugthers.

The daugthers can file suit for partition thereby seeking their share in the property.
