Right of Married Daughters after a will has been executed
15-Jul-2023 (In Property Law)
Hi I am Sneha . 60 years old. My father expired in 2006 n my mother expired in 2010. My father wrote his will against daughter ( me n my sister).don't know that is fake or true.in that will, they declared that his property is distributed in his 3 son and not in daughter. Shall i claim for that ancestors land and my father's land ? I think my 3 brother made that fake will for the property
If your brother is acting on basis of the WILL and have filed application in Court to obtain Probate, then you can intervene and challenge the authenticity of the WILL and dispute the matter. For further guidance, I need to study the WILL and understand background in detail from you.
Yes you can always challenge the originality of will and claim your share in your parents property as per law of sucession.
There is provision for equal rights and if you declare the will illegal then you may get your share in property
