Right of daughter in father's property after recent judgment ?
07-Nov-2023 (In Property Law)
My father died in 1991. After that my brothers unwillingly divided the property amongst themselves alienating me from the property. There was no will left by my father. We challenged there partition in court and came up with a compromise which didn't came into effect and became null and void coz my brothers never gave anything to me. They divided the property amongst themselves and sold many property alienating me.Atlast in 2012 I again had to goto court to ask for my rights this new supreme court verdict came up few days ago. Does this deny my right of a share? My mother was alive though
The Supreme Court Judgement is pertaining to ancesteral property.
If your father had self acquired property and since ince your father died intestate and if it was his self acquired property then as per section 10 of Hindu Succession Act, the property will devolve to all his legal heir including daugthers.
The daugthers can file suit for partition thereby seeking their share in the property.
