If the coloniser has mortgaged your allotted plot to the bank, then they legally cannot transfer or register that plot in your name until the bank releases it. A mortgaged property cannot be validly registered without the bank’s NOC. You should demand written confirmation, copy of the mortgage details, and insist on either immediate NOC or an alternative plot with clear title. You may also file a complaint before RERA for unfair practice. Contact us for more.
