Removal of married daughter from her father's HUF

20-Sep-2024 (In Property Law)
Can a married daughter be removed from her father's HUF. If yes, will the HUF continue to exist or will it be dissolved? What is the procedure for removal? (Both the parties are in mutual agreement)

No agreement can result in waiver of statutory rights. By tradition, any Hindu coparcenary gets equal right in the joint property by birth. depending upon Dayabhaga or Mitakshara laws applicable in your case, you may forgo or waive your interest in favour of someone for a consideration duly received by you. However if doesn't have any legal sanctity and it can be challenged in a civil court later on. HUF cannot take back a legal right if a daughter that she's earned right from her birth. that's the law. feel free to connect with your details and documents for appointment based meetings.
