07-Aug-2026 (In Property Law)
Whether a Cooperative Housing Society in NKDA can bear the cost of it's individual flat owners registration and stamp duty cost. If the answer is NO then how & to whom to escalate such event of transaction seeking resolve, despite the Audit of accounts was cleared by Cooperative Audit wing without any disqualification / disclaimer.

Yes. I would not treat the fact that the cooperative society’s accounts were audited and “cleared” as conclusive proof that payment of individual members’ stamp duty and registration expenses was legally permissible. The issue has to be examined under the West Bengal Co-operative Societies Act, 2006, the West Bengal Co-operative Societies Rules, 2011, the registered bye-laws of the particular housing society, the relevant General Body resolutions, and the purpose for which the society's funds were utilised.
