Regarding land dispute between family
19-Mar-2025 (In Property Law)
My grandfather had given us access to the entire shamlat land, which was under his control. He made an affidavit in my and my sister's name. But my Chacha Ji and Taya Ji have filed a case against us. Someone told us tht if we lose the case, shamlat land will be given to the panchayat, but our personal lawyer assured us there's nothing to worry abt ! Can someone tell me is it true that the shamlat will be given to the panchayat if we lose the case ?
If your grandfather only had possession and not ownership, the land legally belongs to the Panchayat under the Punjab Village Common Lands Act, 1961. If you lose the case, the court may order the land to be returned to the Panchayat. Possession alone does not grant ownership rights over shamlat land. Check revenue records and legal exceptions, but the risk of losing it to the Panchayat is high.
