refund of booking amount and broker commissions
13-Aug-2023 (In Property Law)
Sold property, buyer credited 10 % token money in our account. Failed to arrange rest of money and terminated the contract himself and demanding full refund.with his token money we also booked a flat from his token money for which builder is charging us 10% interest. Now the broker is threatening us, that he will not allow us to sell it to someone else, also asking 1.5% brokerage amount but at the time of deal 1% was fixed, can we send refund through a legal notice.
With all due respect, it is not clear as to which is the property, the broker is not allowing you to sell the property. However, you can file a suit for Specific Performance of the contract against the buyer for enforcing the terms of the contract. you can also send the legal notice prior to filing of the case.
