Purchased a house and registered it but seller not vacating property

purchased a house registered it .now seller is not vacating the house and saying according to law he has 45 days to vacate the house.is it true.

There is no law which requires the seller to vacate the premises after 45 days from the date of the sale. In the sale deed, it is always mentioned that the Seller has on this day offered vacant possession of the schedule property to the buyer.

However, if you have had an understanding with the seller--before or during the sale--that he would vacate the premises after 45 days from the date of the sale, only then he can make such a claim.

To answer your question, the seller's claim that there is a law permitting him to continue to stay on the property for 45 days after the sale, it is false. He has to vacate the premises immediately, if he is not doing so, you can get into an arrangement with him to make him pay rent for those 45 days.

There is no specific law that says that the seller has 45 days to vacate the premises after sale, the seller is technically trespassing. You can lodge a police complaint and they will take action. If that doesn't work, then you can file a suit for eviction.
