13-Oct-2023 (In Property Law)
This concerned property was bought 30 years back but the registration was not been done and from then on the land has been cultivate by the bought party. However at the said time a valid will was made by the person stating that the property no more belongs to him and in any case if the transfer has not been done and if either of the concerned died then it will going to the bought party...new this man died and his sons have registered the property in their name and now the man doesn't know how to go about this...the will clearly states of the property being sold and what happens to it.
Registering the documents relating to the transfer, sale, lease or any other form of disposal of a property is compulsory under section 17 of the Indian Registration Act, 1908. The rights over this property may be challenged unless they are barred by a a limitation period.
